The Role of the Parents/Caretaker in a Birth Injury Lawsuit

As the parent/caretaker of a child with a birth injury your major role in the lawsuit process is to provide accurate, detailed information about you, your child and the medical care and treatment that you both received. In addition to that, you will be expected to act as your child’s legal representative, meaning you will be responsible for signing all legal forms and documents such as a HIPAA form.

Occasionally you will need to meet with your attorney. These meetings are generally relatively infrequent and will occur when the lawsuit has reached a crossroads and a decision needs to be made, or when your attorney needs more information. Your attorney will inform you about how your case is proceeding and will help you make the necessary decisions about the case.
